Trusts

We work with our clients to create a bespoke solution for their particular circumstances, assisting with wealth preservation, succession planning and asset protection.

We can also help with:

  • Forced heirship planning
  • Philanthropic interests
  • Investment holdings
  • Consolidation of assets

The most widely-used types of trusts are:

One of the most flexible types of trust structures as the trustee has complete discretion on when, in what form and how much each beneficiary may receive.

Some discretionary powers of the trustee can require the prior consent of a protector, subject to the specific terms of the trust deed.

The beneficiaries of a fixed interest trust will have specific defined rights in relation to the income and capital of the trust.

A reserved powers trust enables the settlor to reserve specific powers which would normally otherwise be powers vested in the trustee, with the reserved powers either held by the settlor or by a suitable third party

A purpose trust can have either charitable or non-charitable purposes.  Due to the absence of any beneficiaries able to enforce what would usually be beneficiaries’ rights against the trustee, an ‘enforcer’ is required to be appointed.
